This vehicle renting contract between GENPLUS genel yapı, mimarlık, san.tic.ltd.şti. (hereinafter referred to as NOMADIC CARAVAN) owner, ………………………………………………………………………………………… renter, was signed by the above-named parties within the framework of the following provisions. This contract constitutes an inseparable whole with its annexes, and it shall take precedence over any other contract that may be signed between the parties, as well as any advertisements, brochures or verbal declarations and commitments. This contract consists of ten (9) pages and two copies.
Signing this contract or paying any renting charge, renter is deemed to have accepted the aforesaid conditions within the contract and is deemed to have rented the vehicle for the time mentioned in the contract and accepts and undertakes to deliver the vehicle at the delivery point predetermined in the contract.
2.1.The driver (s) mentioned in the contract must be over the age of 23 on the day the contract is signed and not exceeding the age of 69, and must also present that they have had a Turkish driving license for at least 5 years or an international driver's license.
2.2.The renter declares and undertakes to comply with the terms that the vehicle will not be driven: -by any person except those stated in the present contract, -by a person who does not have a license, whose driving class is not suitable or whose license is invalid for any reason; - by a person that has a legal and physical obstacle to driving a vehicle despite his name being mentioned in the present contract; -in the state of alcoholic or drug intoxication; otherwise the renter will undertake all criminal and legal liability that may arise andcompensate for damages to the owner.
2.3.The renter accepts and undertakes not to carry any objects or creatures that are prohibited by law, not to use the vehicle for any illegal activity, not to drive the vehicle on the roads closed for general traffic, not to use the vehicle for any purpose other than its intended use (i.e. for racing, endurance test, towing or pushing another vehicle or object, carrying passengers or goods for money, etc.) and not to cause damage to the tyres beyond its natural wear.
2.4.The Renter declares and undertakes that, without the written consent of NOMADIC CARAVAN, the Renter shall travel with the rented vehicle only within the Mediterranean, Aegean, and Central Anatolia Regions of the Republic of Türkiye and shall not, in any event, leave the territory of the Republic of Türkiye. The route to be taken by the rented vehicle is specified in Appendix No. 1, which forms an integral part of this Contract, and under no circumstances does it include highland roads.
2.5.The Renter agrees and undertakes that the vehicle will not be used to carry any cargo or goods other than baggage, and will only carry number of passengers not exceeding the one determined by the traffic rules. The capacity of the rented vehicle is 3 people including the driver and it cannot exceed 3,5 tons in the loaded condition, driver and passengers included.
2.6.The Renter declares and undertakes that she/he will not accommodate or transport any animals in the rented vehicle without the written consent of NOMADIC CARAVAN.
2.7.Along the renting time, renter is responsible for vehicle’s security, whether the vehicle is parked in the right place, keeping it locked, not losing the keys, licence plate, vehicle licence and other documents belonging to the vehicle.
2.8.The renter is responsible for all kinds of expenses related to the confiscation or seizure of the vehicle by the competent authorities, if it happened due to the renter’s fault. The cost of the rent for the days the vehicle stays at this state will be paid by the renter.
2.9. Renter accepts and undertakes not to misuse the vehicle and its equipments inside, to drive in a way not contaminating and harming the environment, to empty out the foul water and closet tank to the appropriate places and not to smoke inside the vehicle.
2.10. Renter is responsible for controlling tyre pressures, engine oil and water levels, whether the signals and lightings work or not day by day during the renting time. Renter is also responsible for informing NOMADIC CARAVAN of any damages happened to the vehicle, any breakdowns and any mulfunction indications seen in the vehicle.
2.11. In case the breakdowns are not caused by the driver the repair cost shall be paid back to renter by means of invoicing to NOMADIC CARAVAN. In this case the renter must immediately inform NOMADIC CARAVAN of the situation and must get approval from NOMADIC CARAVAN before the repair. If the repair lasts more than one day NOMADIC CARAVAN would allocate another vehicle. If NOMADIC CARAVAN fails to do it, it may only be responsible for paying back the rental over the valid tariff for the days on which the vehicle could not be used.
2.12.NOMADIC CARAVAN shall provide an electronic ticket (HGS) valid for highways and bridges in Turkey. Highway tolls will be covered by the Renter’s deposit payment. However should there be a use of (15 Temmuz Şehitleri Köprüsü etc.) bridge, tunnel or highway forbiden for campervan, the cost of fine and toll will be paid by the Renter.If the sum of all tolls and penalties incurred during the rental period exceeds the deposit amount, the Renter is obliged to pay the difference to NOMADIC CARAVAN.
2.13. Renter is obliged to pay fuel, parking lot, camping area etc. all expenses and the payment of traffic fines during the rental period.
2.14. Under no circumstances can the Renter transfer, assign or terminate the rights arising from this contract, as well pass the vehicle or the devices inside it to somebody else or use it in the way that harms NOMADIC CARAVAN.
3.1 Before delivering the vehicle to a renter, a protocol listing the current situation of the vehicle (visible scratches, dents etc.), and all the operating equipments within the vehicle shall be drawn up (Appendix 2). At the end of the renting time, renter is obliged to deliver the vehicle in a way that he/she received the vehicle, with all the equipments mentioned in Appendix 2 undamaged, the amount of fuel not less than recorded at delivery and the foul waste water tanks emptied. Otherwise, the Renter agrees to compensate for losses and damages and pay an additional fee of 1000 TL if the vehicle is returned without emptying the waste tanks.
3.2 The Renter is obliged to return the refrigerator, bed, WC-bathroom area and kitchen utensils in a clean-hygienic manner while delivering the vehicle at the end of the rental period. Otherwise, the Renter agrees to pay an additional fee of 1500 TL.
3.3 In case the Renter fails to return the official documents (vehicle’s lisence and number plate) together with the vehicle, he/she will be obliged to pay the rent for the whole period until the documents are returned to the owner. In case the documents are lost, all the expenses arising in the process of their renewal shall be borne by the Renter. 3.4 At the beginning of the renting time, NOMADIC CARAVAN is responsible for delivering a vehicle whose periodical maintanences have been carried out, tires are suitable for roads, and which has got a valid vehicle inspection.
3.5 In case the Renter returns the vehicle before the date specified in the contract, he/she cannot request a refund.
3.6 The Renter cannot return the vehicle later than the agreed date or to a different place without consent of NOMADIC CARAVAN. The Renter can return the vehicle to the place different than agreed upon only with permission of NOMADIC CARAVAN and paying extra charge.
3.7 In the event of delivery of the vehicle outside the specified day and time without the permission of NOMADIC CARAVAN, an additional fee of 500TL will be charged for each delayed hour and the Renter is also liable to cover the damage caused by the failure to deliver the vehicle to the next customer.
3.8 The Renter agrees that NOMADIC CARAVAN will use the stolen vehicle notice right in case the vehicle is not delivered on the specified place and date without its informed consent.
3.9 If NOMADIC CARAVAN cannot deliver the vehicle to the Renter at the specified date and place for an unforeseen reason, it is only obliged to pay the rental fee back to the Renter. If the delivered vehicle does not carry the promised features and equipment, a refund will be made to the Renter at a price to be agreed between the parties, but not exceeding 1/4 of the rental price.
3.10 The moment a renter makes a payment of a rental fee in any amount he/she automatically accepts terms of this contract and Renter title being one of the Parties of the present contract.
3.11 In case during the delivery of the vehicle to the Renter NOMADIC CARAVAN notices that the Renter does not meet the conditions written in title 2.2 of this contract , he/she has the right to withdraw from the rental of the vehicle without refunding the rental fee.
3.12 The renter accepts and declares that he has the right to travel 250 km on a daily average during the determined rental period, and that he is obliged to pay a fee of 20 TL/km for the amount of extra distance traveled at the end of the total rental period.
4.1 Charge is determined according to the tariff on the date renter wants to receive the vehicle. One day is calculated over 24 hours, one week is calculated over 7 days, one month is calculated over 30 days. Payments can be made by cash or through a bank transfer.
4.2 Renter can secure the reservation by paying at least 50% of the total rent cost in advance. If there is 15 days or less left to the starting date of the rental the reservation is finalized only by paying 75% of the rental price in advance.
4.3 Reservation is to be finalized after the advance paid by the Renter. The Renter whose reservation is finalized is obliged to pay the remaining rental fee in the periods specified below:
4.4 Cancellation of reservation and change of dates: According to the amount of days left to start date of rental, the following cancellation policies will apply:
4.5 Upon request of the Renter and following consent of NOMADIC CARAVAN the rental period may be extended provided that the price is calculated over the current tariff of that day and paid 48 hours before.
4.6 If the renter wishes to cancel their reservation due to health issues, the renter must provide the owner with an official report from the relevant doctor detailing the condition that prevents them from driving during the reservation period, before the pick-up time. Once the renter's health report is submitted to the owner, the renter and owner will agree on whether the reservation payment will be refunded or the reservation will be postponed to a later date.
When the Renter receives the vehicle he leaves in cash a deposit of 30000 TL (Thirty thousand Turkish lira). In case the vehicle is returned complete with all devices and undamaged at the end of the rental, if there are no traffic and highway fines the deposit is returned in 7 days in full. Otherwise, the damages and compensation to be covered in accordance with the articles of this contract are deducted from the security coverage and the remaining amount is returned to the Renter. If the security coverage is insufficient the Renter is obliged to pay the part exceeding the coverage and not covered by the insurance.
6.1 NOMADIC CARAVAN has insured its rented vehicle with Compulsory Financial Liability and Seat Personal Accident Insurance, as well as Insurance with exemption. Also the delivered vehicle has undergone all necessary legal inspections before delivering to the Renter. The vehicle is insured against damage to the vehicle and to the property of third parties; however, any personal insurance for the renter (including death or bodily injury to the driver and/or passengers) is covered under the Compulsory Financial Liability and Passenger Personal Accident Insurance policy. It does not cover any personal belongings. By signing this agreement, the renter declares that they are aware of the coverage of the vehicle's insurance policies and accept their own responsibilities under the existing policies.
6.2 Insurance covers damage repair costs exceeding 15000 TL (Fifteen ThousandTurkish Liras). Costs of the repair and/or replacement up to 15000 TL (Fifeteen Thousand Turkish Liras)including damage to the vehicle tire (except natural wear) and glass damages shall be borne by the Renter. In the event that the parties cannot agree on the repair cost of the damage, the repair cost determined by the authorized service of the company producing the vehicle will be valid.
6.3 Damage to the living equipment, technological devices, equipment and furniture, accessories, kitchen appliances, satellite and solar panels outside the vehicle due to any incident during the rental period are excluded from the scope of insurance and the Renter is considered responsible for reimbursing damage in any situation that insurance policies do not cover within the exemption limits.
6.4 The loss, theft or damage of any personal belongings of the Renter and other passengers are excluded from the Insurance coverage.
6.5 If the Renter is involved in accident, he/she is obliged to provide correctly filled accident report, police / gendarmerie reports, if any, the driver's license, license, insurance policy samples of the party or parties involved in the accident, and detailed photos showing the accident. The Renter is obliged to immediately notify NOMADIC CARAVAN about the accident. In case of minor damages without injury, if the traffic safety units do not arrive at the accident site, a memorandum will be arranged between the parties involved in the accident with the agreed minutes drawn up by TSRSB.
6.6 Even if the Renter has absolutely no fault in the accident, the Renter is liable to indemnify the damage, if the damage amount cannot be compensated by the insurance of the guilty side involved in the accident, due to wrong filling of accident report or absence of relevant accident documents abovementioned in 6.5 title 6.7 The Renter is obliged to take a copy of the another driver’s alcohol report in case of an accident.
6.8 Renter shall not drive to a region that announced by NOMADIC CARAVAN as not allowed to go to and to the places that were announced by relevant authorities as natural disaster risk zones like heavy snowfall, flood, mudflow, avalanche etc; or to the region undergoing negative social events like riots, state of emergency etc; and all those are out of the comprehensive insurance coverage. Shall the Renter drive to the abovementioned regions, he/she will cover all the damages and losses that may be caused to the vehicle. Renter is responsible for being aware of these announcements.
6.9 The Renter is responsible for the part of the material or physical damages that will be caused to third parties or to the public due to an accident that remains above the Insurance coverage or is excluded from the scope. The Renter will fulfill the obligations such as obtaining documents and testimony that may be required in the cases that may be filed against NOMADIC CARAVAN as a result of all kinds of accidents and damages caused by Renter, and when necessary, give NOMADIC CARAVAN a power of attorney to follow up the compensation rights against third parties.
6.10 In case of accidents involving the unlawful actions of the driver and / or the illegal use of the vehicle, the Renter is obliged to pay the requested compensation, in case the insurer claims damages paid to third parties. If NOMADIC CARAVAN has to pay compensation to the insurer due to the aforementioned reasons, it reserves the right to demand this compensation from the Renter.
6.11 In the event of accidents caused by the driver being under the effect of alcohol and / or drugs, being incompetent or due to exceeding the load limit on the vehicle and that the insurer claims the damage cost referring to the third persons, renter is responsible for paying the claimed indemnity.
7.1 The Renter agrees and undertakes that she will compensate the damages that may arise due to not complying with the terms of this contract and the rent of the days when the vehicle cannot be rented due to the abovementioned damages, at the applicable tariff.
7.2 NOMADIC CARAVAN is obliged to refund only the total rental price and the deposit amount in cases where they cannot provide a booked or alternative vehicle to the Renter for an unforeseen reason. If an alternative vehicle that does not include the promised features is given, the price difference that may occur is returned to the Renter.
7.3 In cases of mechanical failure that prevents the movement and use of the vehicle, except for the cases caused by the Renter during the rental period, NOMADIC CARAVAN will pay the remaining amount of the time to the Renter. In case of a mechanical breakdown, if an alternative vehicle is given to the Renter, the price difference arising from the characteristics of the vehicle in question is returned to the Renter. The Renter will not demand any road or accommodation fee from NOMADIC CARAVAN under any circumstances.
7.4 The time elapsed during the repair of damages and failures caused by the misuse of the driver cannot be added to the rental period and the tenant cannot claim compensation for this period. In the event that it is not clearly understood that the damage and malfunction are caused by the use of the driver, the fault detection report to be made by the service authorized by the company producing the vehicle will be taken as basis.
The parties agreed to resolve disputes according to law of Turkey in Antalya Courts and Law Enforcement Office authorized in case of disputes. The tenant accepts and undertakes that the address written in the contract is the notification address for all kinds of notices, litigation petitions, etc., which will be notified to him regarding the disputes that may arise from this contract, unless the new address is notified to NOMADIC CARAVAN in writing.
